Terms and Conditions

1 – General terms

This document contains terms and conditions applicable to all purchases from POT SISTEMAK S.L. through its website  www.lamotadistribucion.com.

Only if you are over 18 or you have registered your business with the government regulatory agencies will you be allowed to buy from us. By placing an order, buyers accept and agree to be bound by these terms of sale that may apply while the commercial relationship is in force.

2 – Ordering process

All orders must be processed on our website. Nevertheless, should you have any doubts o unexpected problems during the purchase process, do not hesitate to contact our support team for help.

If any of the items ordered were not in stock at the time of purchase, you would be sent those in stock first and the remaining ones as soon as they are back in stock. Should this take long, you could request a refund for the remaining items at any time.

If you fall into the advance payment category, you will have to make the payment using the selected method. No sooner do we verify it than your order will be processed and shipped.
If we've agreed to work on deferred payment terms, your order will be shipped the same day we receive it, as long as it's placed before 12 a.m.

Orders are processed within 24 hours. Under advance payment terms, it'll be shipped as soon as the payment is confirmed. Delivery times from dispatch are 24 hours for shipments within Spain while international shipping delivery times vary depending on weight, volume, and destination.

On receipt of the payment, the order will then be processed and dispatched. The dispatch note and the invoice will also be sent to you.

3 – Shipping methods and delivery times

All shipments include shipping fees as displayed on the invoice. The shipment is considered complete once the recipient has signed the delivery note showed by the courier. 

The recipient is obliged to make an assessment of the outer packaging of the shipment upon delivery and to write any complaints or damages observed on the delivery note. Should the packaging look roughly handled by the courier, the client is free to reject it.

Seeds are delivered in approx. 24 hours, and products in about 24-72 hours, depending on the destination. These delivery times are subject to stock availability as well as to the courier's' working hours and public holidays that may change according to the countries.

If anything out of the ordinary should happen after the delivery, customers must get in touch with POT SISTEMAK S.L. no later than 24 hours from the receipt of the order. 

4 – Return policy

POT SISTEMAK S.L. is responsible for the replacement of faulty items provided the damage does not derive from a bad use or bad handling of the product. Should the client receive a clearly faulty product upon delivery, POT SISTEMAK S.L. will solely agree to the replacement of new products that come in their original packaging. 

Customers can return any product purchased from POT SISTEMAK S.L. within 7 working days of delivery. For doing so, it's necessary to complete the delivery note included in the packaging in full and send it back to us. To be eligible for a refund or exchange, the client must return the product(s) new, in their original packaging, undamaged, along with all accessories, instructions, and documents. In addition to the aforementioned requirements, the guarantee seal of electronic and/or optical devices as well as of products equipped with software must be intact.

Before proceeding to the return, the contents will be thoroughly checked by POT SISTEMAK S.L. in order to verify they are in perfect condition. POT SISTEMAK S.L. will have a period of 15 days after the receipt of the product to inform the customer about the issues found in the returned product. 

Regarding the type of compensation, the customer is entitled to ask for a replacement or a refund.

5 – Limitation of liability

In no event will POT SISTEMAK S.L. be held liable for any damage caused by the customer and/or third parties, derived from a lack of awareness about the handling of the product. 

POT SISTEMAK S.L. shall not be held responsible for an incorrect configuration and/or breakdown of a device if caused by a component not supplied by POT SISTEMAK S.L. 

6 – Applicable law

These Terms and Conditions are governed and shall be interpreted in accordance with the laws applicable in Spain, without reference to any choice of law rules. Civil courts from the country of destination or from the country specified by the contract shall have exclusive jurisdiction to settle any claim or dispute which might arise out of or in connection with these terms and conditions.
